After being caught with a bunch of heroin in his possession while doing jury duty, school administrators placed the case before a school district arbitrator who decided that the teacher was too careless and a threat to the students, and terminated his contract. Now, an appeals judge has overruled the arbitrator and directed the school district to reinstate the teacher even though he admitted to having taught classes while under the influence.
Don’t school districts have employees sign an agreement that binds them to the decision of an arbitrator when an employment dispute occurs? Why bother with a contract at all if it is unenforceable?
